1. Terms and Conditions
1.1 Acceptance of Terms
By accessing this website, registering, enrolling or making any payment through a payment gateway or any other payment method, the user ("Client", "Participant", "User") agrees to be legally bound by these Terms and Conditions, Privacy Policy, No-Refund Policy, Non-Disclosure Agreement (NDA) and Trainer Protection clauses.
If you do not agree to these terms, you must not proceed with payment or use any services.
1.2 Nature of Services
The Company provides professional online and offline training programs, workshops, consulting services, technical education and resale or facilitation of authorized third-party software licenses.
1.3 No Guarantee of Outcomes
The Company does not guarantee employment, certification success, promotions, income, business growth or project allocation. Outcomes depend on individual effort and external factors beyond the Company’s control.
1.4 Intellectual Property Rights
All training materials, content, datasets, documents, videos, recordings, credentials, software files, CAD/GIS files, models, drawings, methodologies and proprietary information are the exclusive intellectual property of the Company or its licensors.
These materials are licensed strictly for the personal, non-transferable use of the enrolled participant. Copying, sharing, resale, publication, circulation, recording or commercial use is strictly prohibited.
1.5 Mandatory Identity Verification
Submission of valid government-issued identity proof (Aadhaar Card, PAN Card, Passport or Voter ID) is mandatory for all participants enrolling in training services.
Failure to submit or verify identity details may result in denial, suspension or termination of services without any refund.
1.6 User Conduct
Users shall not misuse the platform, share credentials, record sessions without written consent, engage in abusive or defamatory conduct, solicit trainers or attempt unauthorized access to systems or content.
1.7 Third-Party Software Licenses
All third-party software licenses are governed by the respective publisher’s End User License Agreement (EULA). The Company acts only as a reseller or facilitator and is not responsible for publisher-side changes, revocations, pricing updates or license restrictions.
1.8 Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special or consequential damages. The total liability of the Company shall not exceed the amount paid by the Client for the specific service.
1.9 Termination of Access
The Company reserves the right to suspend or permanently terminate access to services for violation of these policies, misuse of materials, breach of confidentiality or misconduct, without any refund.
1.10 Governing Law and Jurisdiction
These policies shall be governed by and construed in accordance with the laws of India. Courts located at Solapur, Maharashtra shall have exclusive jurisdiction.
2. No-Refund and No-Cancellation Policy
2.1 All Fees Are Final and Non-Refundable
All fees paid to Zyvion are final and strictly non-refundable.
This includes, but is not limited to:
- Training or course fees
- Registration or enrollment fees
- Application or assessment fees
- Convenience, processing or payment gateway charges
- Software license, subscription or workshop fees
- Any other charges related to enrollment or services
2.2 No Refund or Cancellation After Payment
Once payment is completed (full or partial), no refund, cancellation or reversal request will be accepted at any time, for any reason whatsoever.
This applies irrespective of withdrawal, non-attendance, dissatisfaction, personal reasons, health issues, relocation, scheduling conflicts, incomplete participation or payments made via EMI, NBFC or third-party financing.
2.3 Program Change, Deferment or Pause
Requests for program change, deferment, rescheduling or pause do not entitle the participant to any refund. Fees already paid remain non-refundable.
2.4 No Transfer of Fees
Fees are linked exclusively to the enrolled participant and cannot be transferred or reassigned to another individual under any circumstances.
2.5 Cessation of Access
Upon withdrawal, termination or discontinuation, access to all resources shall cease immediately without refund.
2.6 Chargeback and Payment Dispute Restriction
By making payment, the participant expressly agrees not to initiate any chargeback, reversal or payment dispute with banks, NBFCs, card networks, payment gateways or other payment service providers.
Any such action shall be treated as breach of contract and may result in service suspension and legal recovery proceedings.
If any refund is agreed by us, it will be credited to your original payment method within 7 Days.
3. Privacy Policy
3.1 Information Collected
The Company may collect personal information including name, email, phone number, identity proof documents, transaction references, IP address, device information and usage data.
3.2 Purpose of Data Collection
Data is collected for identity verification, service delivery, fraud prevention, legal compliance and payment reconciliation.
3.3 Data Sharing
Personal data may be shared with payment gateways, software publishers, service providers or statutory authorities as required by law. The Company does not sell personal data.
3.4 Data Security
Reasonable administrative and technical safeguards are implemented. However, no digital system is completely secure.
4. Non-Disclosure Agreement (NDA)
4.1 Confidential Information
All content, datasets, pricing, methodologies, communications and internal information shared during training are confidential.
4.2 Confidentiality Obligation
Participants shall not disclose, copy, reproduce, distribute or exploit confidential information without prior written consent.
4.3 Breach
Any breach of confidentiality may result in immediate termination and legal action including claims for damages and injunctive relief.
5. Trainer Protection Clause
5.1 Protection of Trainers
Participants shall not harass, threaten, defame, solicit or attempt to engage trainers for external or competing work.
5.2 Recording Prohibition
Recording or redistribution of trainer sessions without written consent is strictly prohibited.
5.3 Legal Remedies
Violations may attract civil and criminal remedies under applicable Indian laws.
6. Force Majeure
The Company shall not be liable for delays or failures due to events beyond reasonable control including natural disasters, internet outages, government actions or third-party platform disruptions.
7. Modification of Policies
The Company reserves the right to modify these policies at any time. Continued use of services constitutes acceptance of revised terms.
